Privacy statement

In this privacy policy the following words and expressions shall have the following meanings unless the context requires otherwise:

BC Social House:
The Dutch Limited Liability company The Butch Collective B.V. having its seat in The Hague, The Netherlands and registered at the chamber of commerce under number 69013101.

Brand Owner:
Any brand owner using the services of BC Social House.

Content Agreement:
The agreement between Brand Owner and BC Social House by which Brand Owner shall be licensed to use the Content and Tools of BC Social House.

Content provider:
Any person (including any Influencer) providing Content for the use in any Social House or on the Website.

Influencer:
Any party who has entered into a promotion agreement with Social House providing services on behalf of BC Social House to Brand Owners.

Services:
The services as provided by BC Social House to Brand Owner such as providing access to the Social House, to Content and/or to the Website and any other services in accordance with – or as set out in the Content Agreement and/or Promotion Agreement.

Social House:
The social environment of the Brand Owner as provided by BC Social House on the Website setting out the Content and Tools which could be used by Brand Owner for its marketing purposes.

Tools:
Any tool as provided by BC Social House to Brand Owner to edit or improve the Content for its marketing purposes.

User:
Any Content Provider, Brand Owner and/or any other user of the Website.

Website:
The website as set out on the URL www.socialhouse.online

Introduction

This Privacy Policy applies to the processing of personal data of all our Users with regard to the Services of BC Social House and/or the use of the Social Houses and/or the Website.

In this Privacy Policy we explain how personal data is processed and for which purposes these data are being processed. This Privacy Policy furthermore contains information about our cookie policy. By using the Social Houses, the Website, or any Services of BC Social House the following terms shall apply.

Processing of personal data

BC Social House enables Brand Owners to use Social House and any Content as provided by Content Providers. In addition, BC Social House enables Content Providers (and/or Influencers) to provide Content for the use in the Social Houses of Brand Owners and/or on the Website.

By using the Services of BC Social House process personal data of its Content Providers. This concerns name, address, phone number and email address. Furthermore, financial details, such as a bank account number, are being processed if such details are necessary.

The processing of personal data takes places in the following situations:

a. Formation and execution of an agreement with Influencer;
b. Administrative processing; to offer and/or deliver Content as purchased by Brand Owners;
c. Invoicing; in case of paid Services. Should payment fail, BC Social House may pass on the claim for collection, to a debt collection company;
d. To make a personal account on the website of BC Social House;

In the aforementioned situations the name, address, phone number and email address are necessary for the execution of the agreement.

e. to send user newsletters, offers, user information, service notices and/or other electronic messages that may be relevant for the user, in case the user has explicitly agreed thereto;

In the aforementioned situations the personal data, i.e. e-mail address, are provided optionally for which processing User provides permission.

f. To control, analyze, maintain, optimalise and secure our products and/or services and to detect and deter misuse and/or fraud of our products and/or services;
g. To determinate strategic analyses and reports of our products and/or services; and/or
h. If User visits one of our (mobile) websites, our servers may (automatically) save information such as URLs, IP-addresses, browsertypes, languages, data and times of the visits;

In aforementioned situation BC Social House has a legitimate interest to process personal data.

The provided personal data shall solely be processed by BC Social House for the purpose of the execution of the services and, more specific, the express purpose for which the personal data is collected.

Disclosing personal data is not required

User shall at all times have the option whether or not to disclose personal data. However, for the use of a number of Services it is requested to disclose personal data to BC Social House. If the input of your details is required, BC Social House shall inform you which data are necessary to be able to use our Services.

Rights users

All our Users have certain rights under the GDPR legislation to manage their own personal data:

  • right of access and information;
  • Right of rectification;
  • Right of erasure;
  • Right to object the processing of his/her personal data;
  • Right of data portability; and
  • Right of restriction of processing

In addition, User may withdraw the consent he/she has given to the processing of his data at any time. Furthermore, User has the right to complain about our data processing activities to a data protection authority.

No transfers to third parties

Notwithstanding the below mentioned, only persons authorized by BC Social House for the security and/or processing and/or maintenance of IT-structure have access to personal data of Users.

If, for the purposes as set out in this Privacy Policy, we involved a controller, such as postal services and payment services, we close an agreement with such controller to ensure that the controller offers sufficient assurance with regard to technical and organizational safety measures.

BC Social House shall not provide personal data of its users to third parties unless set out in this Privacy Statement and/or unless this is necessary for the execution of its products and/or Services, on the basis of a statutory provision or in case of an emergency if this is, in the reasonable opinion of BC Social House, in the interest of its Users. This includes legitimate requests of authorities, summons or court orders, acts to investigate or prevent damages or fraud, or acts to guarantee the safety of our network and our Services.

Data collected automatically

Apart from the use of cookies, BC Social House does not collect any data automatically.

Sensitive Personal Data

BC Social does not process sensitive personal data.

Data obtained from third parties

BC Social House does not process personal data obtained from third parties.

Security

BC Social House has taken adequate technical and organizational measures to secure the personal data of its users against loss or unlawful processing, amongst which (i) storage of personal data in a secured database with encrypted passwords and secured backups and (ii) payment orders to BC Social House through secured payment systems.

Retention period

The personal data shall solely be stored during the period which shall be necessary for the execution of the purposes as set out above, unless applicable laws prescribe longer retention periods in which case the personal data shall be stored for the period as prescribed by the applicable laws.
